The primary trigger for a 40/25/10-year building inspection notice in Broward County is the age of the structure.
Key triggers For 40 yr inspection
- Age of the building: A building inspection notice is sent when a qualifying building reaches 25 years of age(as of 2020 not 40 yr anymore), and then every 10 years thereafter. Structural and Electrical inspections must be done
- Property data: Each year, the Broward County Board of Rules and Appeals obtains a list of buildings that will turn 40 or older from the County Property Appraiser’s Office for 40 yr inspection and 25 yr inspection.
- Notice generation: The Board of Rules and Appeals forwards this list to the appropriate city or county building department. The building official then issues a “Notice of Required Inspection” to the owner of each building on the list.
- Owner’s responsibility: While local government building departments send out notices, the ultimate responsibility for ensuring timely recertification lies with the property owner. Even if a notice is not received, the owner is still required to get the recertification completed.
- Milestone inspections: Recent legislation (Florida Senate Bill 4-D) has created milestone inspection requirements for certain buildings. These can change or preempt the 40-year recertification schedule, especially for condominiums that are 25 years old or older and located within three miles of the coast.
- Timeline: After receiving a notice, owners generally have 90 days to have their building inspected and submit the reports.
This system ensures that aging buildings are regularly assessed for structural and electrical safety to prevent failures and protect occupants.
